Terms and Conditions: The use of this site is governed by the policies, terms and conditions set forth below. Please read them carefully. Your use of this site indicates your acceptance of these terms and conditions. Your placement of an order indicates your acceptance of these terms and conditions. Your submittal of any purchase order to Hamcity indicates acceptance of these terms and conditions. These terms and conditions shall supercede any subsequent terms or conditions included with any purchase order, whether or not such terms or conditions are signed by Hamcity. Hamcity reserves the right to make changes to this site and these terms and conditions at any time.

Payment Methods: Hamcity accepts payment via the following authorized credit cards: Discover, MasterCard, Visa and MasterCard/Visa check cards. We also accept checks, money orders, cashier's checks, direct wire transfers. Please be advised that we require exact U.S. billing addresses to fulfill all orders. All credit card orders billing address must match shipping address. For large volume orders and orders placed via open account status, acceptable forms of payment may also include checks, money orders or cashier's checks denominated in U.S. dollars and drawn on a U.S. bank. Terms of payment for large volume orders are determined on a case-by-case basis and are subject to change upon notice.

Warranty Policy: For factory warranty replacements, simply ship the item back to Hamcity at the below address:

Please include a note stating the specific problem(s). Factory warranty replacements take approximately one to two weeks to process from the date of receipt. If Hamcity is out-of-stock on the item, Hamcity will replace it with an equivalent product or issue an in-store credit. Factory warranty does not cover abuse, neglect, or improper installation of product, or acts of nature. PLEASE NOTE: Installation of any of our products is at your own risk. Hamcity is not liable for any damages caused by our products. Damage(s) due to what Hamcity deems customer negligence is not covered under this warranty.

International Warranty Return / Damaged Items Policy: The customer is solely responsible for ALL international and U.S. shipping and customs charges to and from Hamcity.com for returned items due to damages, defects, replacements, warranty or repair issues.

Exchanges and Returns: Returns must be in new condition with original packing. A minimum 15% restocking fee may be charged. No returns or exchanges after 10 days of receipt of item. No refunds or exchanges on special orders, books, tapes, software, earpieces, cable and connectors

Defective Product Returns: If you have discovered that your item is defective, within ten (10) days of receipt, you may return the item to Hamcity for a prompt exchange or a full refund of the purchase price (minus shipping). For returning defective items, please include a copy of your original sales receipt and a note stating the specific problem and specify whether you would like a full refund of the purchase price or you if you would like Hamcity to replace and immediately re-ship the replacement item.

Non-Defective Product Returns: If you are not happy with the product for any reason you may return the item for a full refund of the purchase price (minus shipping) within ten (10) days of receipt. All returns of non-defective merchandise for refund or exchange are subject to a 15% re-stocking fee. Non-defective products must be returned in its original condition with copy of the original sales receipt.

Product Availability: Hamcity is committed to offering the lowest prices and most accurate product information available to our customers. If a product you have ordered is not available for shipment, we will do our best to contact you immediately to provide status on that particular item. Anticipated delivery dates are dependent upon our suppliers and other factors beyond our control and are subject to change. Back order items will not take more than five to seven days for the item to be sent out of our warehouse (unless you are told otherwise).

Used Products/Merchandise: No refunds or exchanges for any used products/merchandise.

Please be advised that the customer is responsible for paying all associated costs, including all shipping costs, for returned items. Please allow up to twelve (12) business days Hamcity has received your return for your replacement or refund to be processed. For refunds, Hamcity.com will credit your account minus the shipping cost, if any, as soon as Hamcity receives the item(s).

Typographical Errors: In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Hamcity shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Hamcity shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Hamcity shall immediately issue a credit to your credit card account in the amount of the charge.

Order Acceptance Policy: Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Hamcity reserves the right at any time after receipt of your order to accept or decline your order for any reason. Hamcity reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $2,000.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. Hamcity may require additional verifications or information before accepting any order. Hamcity is a reseller to end user customers and does not accept orders from computer dealers, exporters, wholesalers or other customers who intend to resell the products offered by Hamcity.

Sales Tax: Hamcity shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within California, Massachusetts, and Indiana. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.

Service and Support: All requests for technical service and support should be made directly to the manufacturer in accordance with their terms and conditions. Hamcity will provide on-line technical notes on most computer hardware and software products.

Jurisdiction and Venue: You agree that any legal action brought against Hamcity shall be governed by the laws of the State of California without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on Hamcity shall be an appropriate federal or state court located in Los Angeles County California.

Classified Section: Hamcity Classified Section brings together buyers and sellers of Wireless Communication Equipment

Information about a particular item is supplied by the seller and not by Hamcity. Price and other terms of any sale remain subject of negotiation between the buyer and seller only. Prices listed by Hamcity sellers often exclude sales tax, finance charges, title, license, regulatory, dealer documentary, compliance fees and other related charges, any or all of which may be added to the listed price to arrive at the final sale price of that particular item. Hamcity cannot verify the information sellers supply or guarantee the item they offer nor can we assure the seller of an item that the monetary check he/she gets from the buyer is valid.

When you offer an item for sale trough Hamcity Classified Section, you must be prepared
to sell that item at the price and terms that you have listed. To list a sales item on Hamcity
Classified Section, sellers are required to provide certain identifying and contact information. The information must accurately identify the seller and method of contact, which must permit buyers to communicate directly with the seller. You may not charge any potential buyer for information about any listed item for sale on Hamcity Classified Section, nor may you use our Web site to promote any other Web site, product or service. Hamcity reserves the rights to deny use of this Web site to anyone who does not comply with these requirements or uses our Web site in a manner we consider inappropriate.

It is the seller's responsibility for listing information: you are responsible for posted materials and email message content sent via Hamcity. Hamcity reserves the right to perform random tests confirming Hamcity sellers are prepared to sell their item at their advertised prices and terms. By using our service, you agree to cooperate in this random tests, If our tests reveal or we learn otherwise that a seller is engaging in unfair or deception, Hamcity can deny that seller our services.

Hamcity reserves the right but assumes no obligation to delete, move or edit any listings not to post or transmit any defamatory, obscene, misleading, abusive, threatening or illegal material or any other material that infringes on the rights of others or interferes with the ability of others to enjoy Hamcity. We retain the right to deny access to anyone we believe has violated these terms or any other terms of this agreement. We will not, in the ordinary course of business review the content of private electronic messages that are not addressed to Hamcity. However, we may occasionally release information concerning such communications when release is necessary to comply with law (including disclosure in response to a request from a law enforcement agency) or to protect Hamcity visitors rights, property or safety.
